Reasonable Accommodations (ADA/Section 504)
A reasonable accommodation is a modification or adjustment to a job, the work environment, or the way things are usually done during the hiring process. These modifications enable an individual with a disability to have an equal opportunity not only to get a job, but successfully perform their job tasks to the same extent as people without disabilities. The ADA requires reasonable accommodations as they relate to three aspects of employment: 1) ensuring equal opportunity in the application process; 2) enabling a qualified individual with a disability to perform the essential functions of a job; and 3) making it possible for an employee with a disability to enjoy equal benefits and privileges of employment. Reasonable accommodations are those adjustments within a work environment that allow an otherwise qualified employee with a disability to perform the tasks required.

Employers are required to provide reasonable accommodations under two separate laws: the Americans with Disabilities Act (ADA) and the Rehabilitation Act of 1973. These laws mandate that employers may maintain the same standards of performance and qualifications needed to gain entry into a job or school program. Therefore, it is expected that the requested accommodation changes the ways that those standards are met without causing an undue hardship for the employer.

  • An individual with a disability within the meaning of the ADA and Section 504 is someone who: (1) has a physical or mental impairment that substantially limits a major life activity; or (2) has a record of an impairment; or (3) is regarded as having an impairment (usually through myth, fear, or stereotype).
  • The individual must be able to perform the essential functions of their position or the position that they hope to hold.
  • The review process is both interactive requires ten days or more to complete once all the necessary documentation has been received from the individual's primary physician.
  • The approved accommodation is reviewed annually and determined on a case-by-case basis.
